Legal gender recognition in India is governed primarily by the Transgender Persons (Protection of Rights) Act, 2019 and the Transgender Persons (Protection of Rights) Rules, 2020. Legal recognition and medical treatment are related topics, but they are not the same process.
Certificate of identity under Section 6
A transgender person can apply for a certificate of identity through the prescribed process. Under the 2020 Rules, the District Magistrate processes the application on the basis of the applicant’s affidavit declaring gender identity, subject to verification of the application particulars, without a medical or physical examination.
National Portal for Transgender Persons
The Government of India operates the National Portal for Transgender Persons for certificate and identity-card related services. Applicants should use the current portal instructions because forms and administrative workflows can be updated.
Revised certificate after change in gender
Section 7 of the 2019 Act provides a separate route for a revised certificate indicating change in gender as male or female after surgery. The Act specifies an application to the District Magistrate with a certificate from the Medical Superintendent or Chief Medical Officer of the medical institution where the surgery was performed.
Updating official documents
A person issued a certificate of identity or revised certificate can use the applicable certificate to seek changes in official identity documents in accordance with the Act, Rules and the procedures of the authority that issued each document.
Does legal gender recognition require gender-affirming surgery?
Not for the Section 6 transgender certificate. The Rules specifically provide affidavit-based processing without medical or physical examination. A person’s legal recognition process should not be confused with whether they are clinically eligible for, want, or need any particular medical treatment.
Medical decisions are separate
Hormone therapy and gender-affirming surgery are healthcare decisions based on individual goals, clinical assessment, informed consent and the requirements that apply to the specific treatment. A legal identity certificate does not by itself determine which medical procedure is appropriate.
